This Indenture
made the third day of April One thousand nine hundred and
twenty five Between Robert Arthur Jones of Thamesmouth The
Cliffs Southend-on-Sea in the COunty of Essex Esquire M.B.E. (hereafter
called "the Vendor") of the one part and The Mayor, Aldermen and
Burgesses of the County Borough of Soutehnd-on-Sea aforesaid (hereafter
called "the Corporation") of the other part Whereas the Vendor is
seised in fee simple in possession free from incumbrances of the
hereditaments hereafter more particularly described and intended to be
hereby assured subject to the stipulations hereafter mentioned and with the
benefit of certain liabilities provisoes covenants and rights of way
contained in the several Indentures of Conveyance set out in the First
Schedule to an Indenture of Conveyance dated the fifth day of December One
thousand nine hundreed and twenty one and made between George Frederick
Cattell of the one part and the Vendor of the part And whereas the
Vendor has agreed with the Corporatino to sell the said hereditaments to hem
for the sum of Five thousand pounds to the intent that the same shall for
ever hereafter be dedicated held used and enjoyed as and for the purposes of
a public park for the benefit of the inhabitants of the County Borough of
Southend-on-Sea and the recreation of the public. Now this Indenture
witnesseth that in pursuance of the said recited agreement and in
consideration of the sum of Five thousand pounds now paid by the Corporation
to the Vendor (the receipt whereof the Vendor hereby acknowledges) The
Vendor as Beneficial Owner hereby conveys unto the Corporation All
that piece or parcel of land situate at Prittlewell in the County Borough of
Southend-on-Sea in the County of Essex containing in the whole Eleven acres
one rood thirty five perches or thereabouts bounded on the north side
thereof by a new road leading from Cuckoo Corner to Sutton Road and on the
east side thereof by portion of Priory Park and on the south side thereof in
part by portion of Priory Park aforesaid and in other part by premises known
as "The Lodge" belonging to the Vendor and on the west side thereof by lands
now or formerly belonging to the said George Frederick Cattell. Together
with the messuage or tenement erected thereon or on some part delineated and
shown in the Plan drawn on these presents and thereon distinguished by being
coloured pink Together also with all tithes (if any) and rent charge in lieu
of tithes (if any) issuing out of or payable in respect of the said piece or
parcel of land hereby conveyed. To the intent that the same if not already
merged may henceforth merge and be extinguished in the freehold and
inheritance of the said piece or parcel of land And Together further with
the full benefit of the said Indentures of Conveyance set out in the First
Schedule to the said Indenture of the fifth day of December One thousand
nine hundred and twenty one and of the covenants on the part of the
Corporation and the Vendor thereon contained respectively. To hold
the hereditaments and premises hereby assured unto and to the use of the
Corporation and their assigns subject to the stipulations set out in the
Second Schedule to the said recited Indenture of Conveyance dated the fifth
day of December One thousand nine hundred and twenty one so far as the same
are released as therein mentioned and are still subsiding and capable of
taking effect, and also subject to the liabilities, provisoes, covenants and
rights of way contained in the said several Indentures of Conveyance set out
in the First Schedule to the said recited Indenture of COnveyance of the
fifth day of December One thousand nine hundred and twenty one. To the
intent that the said hereditaments shall forever hereafter be dedicated held
used and enjoyed as and for the purposes of a Public Park for the benefit of
the inhabitants of the County Borough of Southend-on-Sea and the recreation
of the public. In witness whereas the Vendor has hereunto set his
hand and seal and the Corporation have caused their Common Seal to be
affixed the day and year first above written.
